These Terms of Use ("Hub Terms") govern access to and use of the Effortless Home Hub, the online hub, application, and related digital services (collectively, the "Hub") made available by The Effortless Home, LLC ("Company," "we," "us," or "our"). By creating an account, logging in, or otherwise accessing or using the Hub, you ("User," "you," or "your") agree to be bound by these Hub Terms.
These Hub Terms apply to all Users of the Hub, including Clients, Home Specialists and other independent contractors, and Company staff and administrators. These Hub Terms govern your use of the Hub platform itself. They do not replace, and should be read alongside, any separate agreement governing the underlying services or engagement between you and the Company, including the General Terms and Conditions, applicable Service Addenda, or any Independent Contractor Agreement (collectively, "Service Agreements"). In the event of a conflict between these Hub Terms and a Service Agreement regarding the substance of services provided, the Service Agreement controls; in the event of a conflict regarding use of the Hub platform itself, these Hub Terms control.
Section 1. Eligibility & Account Types
1.1 Eligibility
You must be at least eighteen (18) years of age and capable of forming a binding contract to create an account or use the Hub. By using the Hub, you represent that you meet these requirements.
1.2 Account Types
The Hub supports multiple categories of Users, including Clients, Home Specialists and other independent contractors engaged by the Company, and Company staff or administrators. Available features, permissions, and visibility within the Hub may vary by account type and may change over time at the Company's discretion.
1.3 Account Registration
You agree to provide accurate, current, and complete information when creating an account and to keep that information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify the Company promptly of any unauthorized use of your account or any other breach of security.
Section 2. Description of the Hub
The Hub is a platform that may allow Users to perform functions including, but not limited to, scheduling and booking services, viewing invoices and payment history, managing account and payment information, communicating with the Company and other Users, accessing relevant documents (such as service agreements, contractor agreements, or onboarding materials), and viewing status updates related to services or placements. The Company may add, modify, or remove Hub features at any time without prior notice. The Company does not guarantee that any particular feature will be available at all times or will remain available indefinitely.
Section 3. Acceptable Use
You agree not to:
- Use the Hub for any unlawful purpose or in violation of any applicable law or regulation
- Provide false, inaccurate, or misleading information
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity
- Attempt to gain unauthorized access to any account, system, or network connected to the Hub
- Interfere with or disrupt the operation of the Hub, including through introduction of viruses, malware, or other harmful code
- Use any automated means, including bots, scrapers, or data-mining tools, to access or extract data from the Hub without prior written consent
- Copy, modify, reverse engineer, decompile, or create derivative works based on the Hub or its underlying software
- Use the Hub to harass, threaten, or harm another User
- Circumvent any security feature or access restriction of the Hub
- Use the Hub to solicit, recruit, or contract directly with another User in a manner that violates the non-solicitation or non-circumvention provisions of any applicable Service Agreement
The Company reserves the right to investigate and take appropriate action against any User who violates this section, including suspension or termination of account access, removal of content, and reporting to law enforcement where warranted.
Section 4. User Content & Communications
4.1 User Content
Users may be able to submit information, messages, documents, reviews, photographs, or other content through the Hub ("User Content"). You retain ownership of your User Content, but you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, store, and display User Content as reasonably necessary to operate the Hub and provide services, including sharing relevant User Content between Clients, Home Specialists, and Company staff as necessary to facilitate services.
4.2 Responsibility for Content
You are solely responsible for the accuracy and legality of any User Content you submit. The Company does not endorse and is not responsible for User Content submitted by other Users. The Company reserves the right, but is not obligated, to monitor, review, or remove User Content that violates these Hub Terms or applicable law.
4.3 Messaging
Any messaging features within the Hub are intended for communication related to the services provided by the Company. The Company reserves the right to access, review, and retain messages sent through the Hub for quality assurance, dispute resolution, safety, and legal compliance purposes, consistent with Section 8 below.
Section 5. Payments Processed Through the Hub
5.1 Third-Party Payment Processing
Payments made or received through the Hub may be processed by a third-party payment processor. By submitting payment information through the Hub, you agree to the applicable payment processor's terms of service and privacy policy, in addition to these Hub Terms. The Company is not responsible for the acts, omissions, errors, or security practices of any third-party payment processor.
5.2 Authorization
By submitting payment information through the Hub, you authorize the Company and its payment processor to charge the applicable payment method for fees owed under your Service Agreement, including recurring charges where applicable (such as monthly retainers or memberships).
5.3 Accuracy of Payment Information
You are responsible for maintaining accurate and current payment information in the Hub. The Company is not responsible for failed payments, late fees, or service interruptions resulting from outdated or inaccurate payment information.
5.4 No Storage of Full Payment Credentials
The Company does not store full credit card or bank account numbers on Company-controlled systems; such information is maintained by the Company's third-party payment processor in accordance with applicable data security standards.
Section 6. Documents & Electronic Signatures
The Hub may allow Users to view, download, or electronically sign documents, including Service Agreements, contractor agreements, invoices, and onboarding materials. You agree that electronic signatures executed through the Hub or a connected e-signature platform are legally binding and have the same effect as a handwritten signature, consistent with Section 32 of the General Terms and Conditions.
Section 7. Intellectual Property
The Hub, including its design, software, text, graphics, logos, and other content (excluding User Content), is the property of the Company or its licensors and is protected by intellectual property laws. Except as expressly permitted by these Hub Terms, you may not reproduce, distribute, modify, or create derivative works of any part of the Hub without the Company's prior written consent. "The Effortless Home," "Effortless Home Hub," and associated logos are trademarks of the Company and may not be used without prior written permission.
Section 8. Privacy & Data
8.1 Privacy Policy
Use of the Hub is governed by the Company's Privacy Policy, which describes in detail the categories of personal information collected, how that information is used and shared, the service providers and processors the Company works with, applicable data retention periods, and the privacy rights available to you. The Privacy Policy is incorporated into and made part of these Hub Terms by reference and is available on the Company's website and within the Hub. By creating an account or using the Hub, you acknowledge that you have had the opportunity to review the Privacy Policy and consent to the collection, use, and storage of information as described in it.
8.2 Marketing Communications
The Company may send marketing communications regarding its services through the Hub, email, or other channels, consistent with the Privacy Policy. You may opt out of marketing communications at any time using the unsubscribe mechanism provided or by contacting the Company; service and transactional communications necessary to provide the Service (such as booking confirmations and account notices) cannot be opted out of while your account remains active.
8.3 SMS / Text Messaging Program
Text messages are sent only if you provide a mobile phone number and separately opt in. The Company offers two SMS programs:
- Account & appointment texts. This program delivers appointment confirmations, visit reminders and arrival notifications, schedule changes and booking updates, and account notifications.
- Marketing texts. This optional program sends promotions, seasonal tips, special offers, and announcements.
Message frequency varies. Message and data rates may apply. Reply STOP to opt out of that program, or HELP for assistance. Opting out of SMS does not opt you out of email or in-app notifications. Consent to receive text messages is not a condition of purchasing any goods or services.
Carriers are not liable for delayed or undelivered messages. No mobile information (including your phone number and SMS consent) will be shared with or sold to third parties or affiliates for their own marketing or promotional purposes, and text-messaging opt-in data is never shared with any third parties. 8.4 No Sale of Personal Information
Consistent with the Privacy Policy, the Company does not sell User personal information to third parties.
Section 9. Account Suspension & Termination
9.1 Suspension or Termination by Company
The Company may suspend or terminate your access to the Hub at any time, with or without notice, for conduct that violates these Hub Terms, presents a security risk, is fraudulent, or is otherwise harmful to the Company, other Users, or third parties. Suspension or termination of Hub access does not, by itself, terminate any underlying Service Agreement, which remains governed by its own termination provisions.
9.2 Voluntary Deactivation
You may request deactivation of your Hub account at any time by contacting the Company. Deactivation of your Hub account does not relieve you of any payment or other obligations under an applicable Service Agreement.
9.3 Effect of Termination
Upon termination of Hub access, your right to use the Hub immediately ceases. The Company may retain account information and User Content following termination as described in Section 8 and Section 17 of the General Terms and Conditions.
Section 10. Availability & Modifications
The Company will make reasonable efforts to keep the Hub available and operating properly but does not guarantee uninterrupted, error-free, or secure access. The Hub may be unavailable from time to time due to maintenance, updates, technical issues, or circumstances beyond the Company's control. The Company reserves the right to modify, suspend, or discontinue the Hub, in whole or in part, at any time, with or without notice.
Section 11. Disclaimer of Warranties
The Hub is provided on an "as-is" and "as-available" basis. The Company disclaims all express and implied warranties with respect to the Hub, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. The Company does not warrant that the Hub will be free of viruses or other harmful components.
Section 12. Limitation of Liability
To the maximum extent permitted by law, the Company's total liability for any claim arising out of or relating to your use of the Hub shall not exceed one hundred dollars ($100). In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Hub, including loss of data, loss of business, or service interruption, even if the Company has been advised of the possibility of such damages. This limitation applies to use of the Hub platform itself and does not limit or modify the separate limitation of liability provisions applicable to underlying services under Section 22 of the General Terms and Conditions.
Section 13. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its owners, officers, employees, contractors, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Hub, your User Content, your violation of these Hub Terms, or your violation of any applicable law or third-party right.
Section 14. Third-Party Services & Links
The Hub may contain links to or integrations with third-party websites, applications, or services, including payment processors and e-signature platforms. The Company does not control and is not responsible for the content, terms, or practices of any third-party service. Your use of any third-party service is subject to that third party's own terms and privacy policy.
Section 15. Changes to These Hub Terms
The Company may update these Hub Terms from time to time. Material changes will be communicated through the Hub or via the contact information associated with your account. Continued use of the Hub following such notice constitutes acceptance of the updated Hub Terms. If you do not agree to the updated terms, you must discontinue use of the Hub.
Section 16. Dispute Resolution & Governing Law
Any dispute arising out of or relating to your use of the Hub shall first be addressed through good-faith informal negotiation. If unresolved, the parties agree to submit the dispute to binding arbitration administered in King County, Washington, consistent with Section 30 of the General Terms and Conditions. Both parties waive any right to a jury trial. These Hub Terms shall be governed by the laws of the State of Washington, without regard to conflict of law principles, with exclusive venue in King County, Washington.
Section 17. Miscellaneous
17.1 Entire Agreement
These Hub Terms, together with any applicable Service Agreement and Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Hub.
17.2 Severability
If any provision of these Hub Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.
17.3 No Waiver
The Company's failure to enforce any provision of these Hub Terms shall not be deemed a waiver of that or any other provision.

Acknowledgment
By creating an account, logging in, or otherwise accessing or using the Effortless Home Hub, you acknowledge that you have read, understand, and agree to be bound by these Terms of Use.
